41 Rent increases

(1) The rent payable under a residential tenancy agreement may be increased only if—

(a) the tenant is given a written notice by the landlord or the landlord's agent specifying the increased rent and the day from which it is payable, and

(b) the notice is given at least 60 days before the increased rent is payable.

(1A) The rent payable under a residential tenancy agreement—

(a) may not be increased within 12 months after the start of the tenancy, and

(b) may not be increased more than once in any period of 12 months.

Section 9

Methodology

A bond is lodged at the start of a tenancy. The lodgement records the weekly rent agreed. Lodgements are grouped by postcode, dwelling type, bedroom count and month. Each group is a cell.

For each cell, the recorded rents are sorted from lowest to highest. Three figures are then taken. The first is the rent one quarter of the way along. The second is the rent halfway along, which is the median. The third is the rent three quarters of the way along. The count of lodgements in the cell is n, published with every figure.

Sample sizes are small. Across the whole dataset the middle cell holds 2 lodgements, and 86 per cent hold fewer than 10. Every cell therefore carries a confidence tier, and the tier decides how finely the scale beside it is cut.

  • Adequate, n of 30 or more. Scale cut in $25 steps.
  • Thin, n of 10 to 29. Scale cut in $50 steps, span hatched.
  • Very thin, n of 1 to 9. Scale cut in $100 steps, span hatched more densely.
  • No sample, n = 0. The scale is drawn uncut, with no span and no median.

A quartile taken from five lodgements is not known to the nearest $25, so the instrument does not offer to read it that way.

Rents are dollars per week, as recorded. Figures are not adjusted for inflation, property condition, furnishing or any other characteristic.
